محددات جديدة تدخلها الصين لقائمة "الكيانات الأجنبية غير الموثوقة"

ذكرت وزارة التجارة الصينية اليوم أن الصين ستأخذ بعين الاعتبار أربعة عوامل عند وضع قائمة "الكيانات الأجنبية غير الموثوقة".

وأعلنت الوزارة يوم الجمعة الفائت أن البلاد ستضع القائمة بناء على القوانين واللوائح المعنية لحماية الأمن الوطني والمصالح العامة وحقوق الشركات الصينية ومصالحها.

وستنظر الحكومة أولا فيما إذا كان الكيان الأجنبي تبنى إجراءات تمييزية تجاه الكيانات الصينية، من بينها حظر أو تخفيض الإمدادات، قبل وضعها على القائمة، بحسب تشي لو شون، مسؤول بارز بمكتب الصناعة والأمن ومراقبة الصادرات والواردات بالوزارة.

محددات/عوامل جديدة

وفقا ل تشي لو شون فإن الوزارة ستأخذ بعين الاعتبار ثلاثة عوامل أخرى:

1- إذا كان الكيان الأجنبي انتهك قواعد السوق أو روح العقد لغرض غير تجاري.

2- إذا كان الكيان تسبب في ضرر حقيقي بالشركات الصينية أو الصناعات المعنية.

3- إذا كان الكيان يشكل تهديدا حقيقيا أو محتملا للأمن الوطني الصيني.

وأوضحت الوزارة أن الصين ستتخذ كل الإجراءات القانونية والإدارية ضد الكيانات المدرجة على القائمة بالتوافق مع قانون التجارة الأجنبية الصيني وقانون مكافحة الاحتكار وقانون أمن الدولة وغيرها من القوانين واللوائح ذات الصلة.

وأضاف تشي أن الشعبة الصناعية الدولية متشابكة وسوء استخدام بعض الدول للولاية القضائية طويلة الذراع سيوجه ضربة قوية للنمو الاقتصادي العالمي وأمن واستقرار سلاسل الإمدادات وسلاسل القيمة الدولية.

كما ستخضع الشركات أو الأفراد، على القائمة، لإجراءات تحقيقات معينة وستمنح السلطات حاملي الأسهم حقوقا معينة للدفاع عن أنفسهم. وستكشف السلطات عن المزيد من التفاصيل قريبا، وفقا لما قال وانغ خه جون، مدير مكتب التحقيقات والعلاجات التجارية بالوزارة.
